The Dutch Forwarding terms (most recent version), filed at the Office of the District Court(s) in Amsterdam, Rotterdam, Breda and Arnhem by Fenex, the Netherlands Association for Forwarding and Logistics, apply to the work of OTX Logistics BV. These general terms, also called FENEX terms, apply as a standard arrangement in the legal relationship between individual forwarders and their clients. They can be regarded as provisions of a standard contract that are part of the forwarding agreement. It is generally accepted to stipulate the FENEX terms when concluding forwarding agreements. A forwarding agent does not have to commit himself to transport, but he has to commit himself to commission the transport of goods. Attention! In the FENEX terms the liability of the service provider is limited. It is therefore important that the client sees to it that his goods are insured. Or: that client explicitly orders the service provider to insure the goods for him.
